He claimed that he was not guilty of bigamy because Mrs. Loveless had a husband living and undivorced when she married him. An attorney investigated and found that Barjarow's story was true. Mrs. Loveless, when a girl, had married a man in Virginia. He deserted her and she married Loveless, without the formality of divorce. Loveless got out of the way, in legal form, all right enough, by kindly dying but the fact remained that she was legally the Virginia man's wife, and Barjarow's claim that he was 'more sinned against than sinning' was proven to the satisfaction of the state's attorney, who dismissed the case against him." -- Chillicothe Constitution, April 25, 1902.
